IMPORTANT NOTICE: THESE TERMS CONTAIN A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER IN SECTION 15. BY ACCEPTING THESE TERMS, YOU AGREE TO RESOLVE ANY DISPUTES WITH BEACON PARKING GROUP, INC. THROUGH INDIVIDUAL ARBITRATION RATHER THAN IN COURT OR THROUGH A CLASS ACTION. PLEASE READ SECTION 15 CAREFULLY.

1. Agreement to Terms


These Terms of Service ("Terms") constitute a legally binding agreement between you ("Guest" or "you") and Beacon Parking Group, Inc. ("Beacon," "we," "us," or "our"), a Delaware corporation with its principal place of business at 120 Main Street, Bridgewater, MA 02324, governing your use of Beacon's parking management platform, including the mobile web application, QR code scanning system, rewards program, leaderboard campaigns, and all related features and services (collectively, the "Platform").


By tapping "Accept" or otherwise indicating your acceptance of these Terms, you represent that you have read and understood these Terms and agree to be bound by them. If you do not agree to these Terms, you may not use the Platform. Your acceptance of these Terms constitutes your electronic signature under the Electronic Signatures in Global and National Commerce Act (E-SIGN Act), 15 U.S.C. § 7001 et seq.


These Terms are separate from and in addition to any terms of admission, guest agreement, or other terms imposed by the property you are visiting (the "Property"). Beacon is not a party to your agreement with the Property.

2. Beacon's Role — Technology Facilitator Only


Beacon is a technology company that provides parking management, payment processing facilitation, guest engagement, and loyalty software to ticketed attractions and entertainment venues. Beacon is not the owner, operator, or manager of any parking lot or facility.


The parking lot you are using is owned and operated by the Property. The Property makes all decisions regarding parking configuration, pricing, enforcement, reward design, leaderboard prizes, charitable donation partners, and all other operational matters. Beacon facilitates the technology that enables these programs; it does not control, direct, or supervise the Property's operations.


Beacon makes no representations and assumes no liability with respect to:

  • The physical condition, safety, security, lighting, or accessibility of any parking lot or facility

  • The accuracy or completeness of any information configured in the Platform by the Property

  • Any decisions made by Property staff regarding enforcement, reward fulfillment, or guest interactions

  • Any damage to vehicles, personal property, or persons occurring in or around any parking lot or facility

The Property is solely responsible for all premises-related liability, enforcement decisions, and the fulfillment of any rewards or prizes offered through the Platform.

3. Eligibility and Account Holder Responsibility


The Platform is intended for use by adults 18 years of age or older. By accepting these Terms, you represent that you are at least 18 years old and that you have the legal authority to park the vehicle associated with your account.
You are the account holder of record. Your account is associated with the phone number you provide. You are responsible for all activity that occurs in connection with your phone number and account, regardless of who initiates that activity.


By accepting these Terms on behalf of any minor passengers traveling in your vehicle, you accept these Terms on their behalf and represent that you have the authority to do so.


You are responsible for the accuracy of all information you provide through the Platform, including your phone number, name, vehicle license plate number, and any other information submitted. Beacon relies on guest-provided information to operate the Platform, including for purposes of guest recognition, VIP tier assignment, and enforcement status determination. Beacon is not liable for any outcome arising from inaccurate information you submit.

4. Payment Terms


4.1 Parking Fees


Parking fees are set entirely by the Property and are subject to change at the Property's discretion. Beacon does not set, control, or guarantee parking rates. All configured rates are displayed to you in the Platform before you complete payment.

4.2 Payment Processing


Payment is processed by Stripe, Inc. ("Stripe"), a third-party payment processor. Beacon does not collect, store, or have access to your payment card information at any point. By completing a payment, you acknowledge that Stripe processes your transaction data in accordance with Stripe's own Privacy Policy, available at stripe.com/privacy. The Property is the merchant of record on all parking transactions.

Accepted payment methods include credit card, debit card, Apple Pay, Google Pay, and PayPal, as made available in the payment flow.

4.3 Pre-Purchased Parking


If you purchase parking in advance through the Property's ticketing system, your parking session is established at the time of purchase. Pre-purchased parking is non-refundable once you have arrived at the property and your arrival has been recorded in the Platform.

4.4 Taxes


In jurisdictions where parking sales tax applies, applicable tax is automatically calculated and added to your transaction at checkout. Tax collection and remittance are the responsibility of the Property as merchant of record.

4.5 Refunds


Refund eligibility and policy are determined entirely by the Property. Beacon does not make independent refund decisions. To request a refund, contact the Property's Guest Services directly. If you have a billing dispute, you agree to contact Beacon at info@gobeacon.us or the Property's Guest Services to seek resolution before initiating a chargeback with your card issuer. This does not limit your right to exercise any chargeback rights available to you under applicable law.

4.6 Chargebacks


If you authorize a parking transaction and receive the benefit of the parking session, you agree not to dispute that charge with your card issuer. Initiating a chargeback for a transaction you authorized and benefited from may constitute a violation of these Terms and may result in suspension of your account.

5. Guest Classification and VIP Recognition


Beacon classifies guests as General Admission ("GA") or VIP based on information provided by the Property's point-of-sale system ("POS"). VIP status indicates that you hold a parking privilege — such as free parking, a discounted rate, or a finite entitlement — associated with a season pass, cabana rental, group package, or other purchase.


VIP recognition depends on the accuracy of data the Property has provided to Beacon through its POS integration. If your VIP status is not recognized at arrival, please visit the Property's Guest Services window for assistance. Beacon is not responsible for recognition failures arising from inaccurate or incomplete POS data.


Tier-based discounts and entitlements are applied automatically at the time of scan based on your recognized tier. When you hold multiple tiers, the system automatically applies the appropriate tier in the order most favorable to your long-term entitlements.

6. Trip-Based Rewards Program


6.1 Program Overview


The Trip-Based Rewards program allows guests to earn rewards based on the number of qualifying visits to a participating Property. Rewards are configured entirely by the Property and may include food and beverage items, merchandise, admission benefits, or other items at the Property's sole discretion.

6.2 Property Configuration


All reward types, visit thresholds, descriptions, redemption instructions, and availability are set by the Property. Beacon makes no representations about what rewards will be offered, their monetary value, their continued availability, or any other characteristic. The Property may modify, suspend, or discontinue any reward at any time without notice.

6.3 Earning and Redemption


Rewards are earned upon completing a qualifying scan through the Platform. A qualifying scan requires physical presence at the Property and use of an authorized QR code. Refreshing a previously loaded page, scanning from outside the Property, or any other method of simulating a visit does not constitute a qualifying scan and will not count toward reward progression.


Rewards are redeemable on the same visit they are earned, at the specific location and in the manner described by the Property in the reward details. To redeem a reward, visit the location designated in the reward description. Property staff will verify your eligibility in the Platform and fulfill the reward.

6.4 Expiration


Reward expiration terms are set by the Property and disclosed at the time a reward is earned. Unclaimed rewards expire within the time period designated by the Property, which may be as short as 24 hours. Expired rewards cannot be reinstated. At seasonal properties, rewards may expire at the end of the operating season. At year-round properties, rewards may expire within a defined number of days from the date earned.

6.5 No Cash Value


Rewards have no cash value and may not be transferred, sold, exchanged, or redeemed for cash or cash equivalents under any circumstances. Rewards are non-transferable and may only be redeemed by the account holder to whom they were earned.

6.6 Separate Tracks


Reward tracks for GA guests and VIP guests are maintained separately and reflect the different visit patterns and spending behaviors of each group. GA guests and VIP guests do not compete on the same reward track.

7. Leaderboard Campaigns


7.1 Program Overview


Leaderboard Campaigns are visit-based competitions in which guests accumulate points per qualifying scan and compete for prizes designated by the Property. Separate leaderboards are maintained for GA guests and VIP guests. Guests see only the leaderboard for their own classification.

7.2 Entry


Guests may enter a Leaderboard Campaign by scanning a Beacon QR code in the parking lot upon arrival or by scanning a Beacon QR code placed inside the Property ("In-Park QR"). No payment is required to enter a Leaderboard Campaign via an In-Park QR. Guests who enter via the In-Park QR are routed to the appropriate leaderboard based on their recognized tier:

  • Guests recognized as season passholders or VIP tier holders are routed to the VIP leaderboard

  • Guests recognized as General Admission or not previously in the Beacon system are routed to the General Admission leaderboard

All entry methods — parking QR scan and In-Park QR scan — accumulate leaderboard points equally. One qualifying scan equals one point regardless of entry method.

7.3 Prize Selection


At the conclusion of each campaign period, guests who have accumulated sufficient points to qualify for the top-ranking pool become eligible for a random prize drawing. The number of qualifying positions and the number of prizes awarded are set by the Property and disclosed in the official campaign rules. Selection from the qualifying pool is made by random draw. Official campaign rules, including prize description, approximate retail value, eligibility criteria, drawing date, odds of winning, and no-purchase-necessary entry instructions, are available within the Platform and at the Property.

7.4 Prize Fulfillment and Tax


All prizes are funded, provided, and fulfilled entirely by the Property. Beacon makes no representations about prize availability, value, or fulfillment. Winners of prizes with an approximate retail value of $2,000 or more in a calendar year may be required to provide their Social Security number for federal tax reporting purposes and will receive IRS Form 1099-MISC from the Property. By participating in a Leaderboard Campaign, you acknowledge this potential tax obligation.

7.5 Anonymous Participation


You may toggle anonymous participation on at any time, which hides your name from the public leaderboard display. Your position and points continue to accumulate normally. Toggling anonymous participation off constitutes your affirmative consent to have your name used in connection with leaderboard standings, winner announcements, and promotional communications by the Property or Beacon relating to the campaign. This consent is stored in your account record.

7.6 Property Configuration


All campaign parameters — prize description, point values, campaign duration, qualifying pool size, and rules — are configured by the Property. Beacon may deactivate, reset, or modify leaderboard functionality at any time for technical or operational reasons.

7.7 Disqualification


Beacon reserves the right to disqualify any guest from a Leaderboard Campaign for fraudulent scan activity, manipulation of visit count, creation of multiple accounts, or any other violation of these Terms. Disqualification may result in forfeiture of all accumulated points and prizes.

8. Charitable Donations


Each Property designates a nonprofit charitable organization to receive a portion of parking revenue. The specific donation percentage applicable to your visit is disclosed in the Platform's payment flow prior to the completion of your transaction. Donation amounts are calculated as a percentage of gross parking revenue and are deducted before Beacon's revenue share is applied.


The selection of the charitable organization, the administration of the donation relationship, and all compliance with applicable charitable solicitation laws — including any state-level commercial co-venture registration or written agreement requirements — are the sole responsibility of the Property. Beacon makes no representations about any charitable organization's legal status, tax-exempt designation, or use of funds. Charitable contributions facilitated through the Platform are made to the Property's designated nonprofit, not to Beacon.

9. SMS Communications


9.1 Transactional Messages


By providing your phone number and accepting these Terms, you consent to receive the following transactional SMS messages from Beacon regardless of your marketing SMS preference:

  • A one-time verification code upon first scan or following a Terms of Service update requiring re-authentication

  • A enrollment confirmation SMS when you are added to the Platform as a season passholder or VIP guest

Transactional messages are necessary for the operation of the Platform and cannot be opted out of without forfeiting access to the Platform.

9.2 Marketing Messages


Marketing SMS — including rewards reminders, promotional messages, event announcements, and re-engagement communications — are sent only to guests who have affirmatively opted in on the separate SMS consent screen presented after acceptance of these Terms. Your decision to opt in or opt out of marketing SMS has no effect on your access to the Platform or any feature thereof.

9.3 Message Frequency


Transactional messages are sent as triggered by your use of the Platform. If you opt in to marketing SMS, you may receive marketing messages after each qualifying scan, as well as periodic promotional messages from the Property. Message frequency varies based on your visit frequency and Property-initiated campaigns.

9.4 Opting Out


You may opt out of marketing SMS at any time by replying STOP to any marketing message. You may also opt out by emailing info@gobeacon.us. Opt-out requests submitted by email will be processed within 10 business days. Opting out of marketing SMS does not affect delivery of transactional messages. Upon opting out, you will receive one final confirmation message with no promotional content.

9.5 HELP Requests


Text HELP to any Beacon SMS number to receive contact information for Beacon Parking Group, Inc.

9.6 Message and Data Rates


Standard message and data rates may apply depending on your mobile carrier plan. Beacon is not responsible for any charges imposed by your carrier.

9.7 Sender


SMS messages are sent on behalf of the Property by Beacon Parking Group, Inc. using Twilio, Inc. as the SMS delivery provider.

10. Data and Privacy


Beacon's collection, use, and sharing of your personal information is described in our Privacy Notice, which is incorporated into these Terms by reference and available at [PRIVACY NOTICE URL]. By accepting these Terms, you acknowledge that you have reviewed the Privacy Notice.


Key data practices relevant to your use of the Platform include:

  • Beacon receives guest data — including name, phone number, and tier designation — from the Property's point-of-sale system for purposes of VIP recognition and parking entitlement verification

  • Your personal information, including visit history and contact information, may be shared with the Property for the Property's own marketing and operational purposes

  • Beacon uses aggregated, anonymized data across its platform for internal analytics and product improvement; this data does not identify individual guests

  • Payment card data is processed directly by Stripe and is never accessed or stored by Beacon

  • Your license plate number is used solely for parking compliance verification and is not cross-referenced with vehicle registration databases or used to identify vehicle owners through third-party sources

Guest data is retained by Beacon indefinitely unless you submit a deletion request to info@gobeacon.us. Deletion requests will be honored subject to any legal retention obligations.

11. Parking Enforcement


11.1 Enforcement Authority


All parking enforcement at a Property is conducted by the Property or its designated staff and contractors. Beacon provides the technology that enables enforcement monitoring; Beacon does not direct, supervise, or conduct enforcement activities and has no authority over any enforcement decision made at any Property.

11.2 Lot Monitoring


Parking lots at participating Properties may be monitored by Property staff using license plate scanning technology. Vehicles in designated paid or premium spaces that do not have a valid scan on record may be subject to enforcement action at the Property's discretion.

11.3 Warnings


Before any immobilization is applied, guests who have not completed a parking scan typically receive a written warning. Warning issuance, content, and escalation decisions are made entirely by the Property.

11.4 Vehicle Immobilization


For repeat non-compliance, the Property may authorize immobilization of a vehicle using a Barnacle device or comparable equipment. Immobilization fees are set by the Property. A portion of immobilization fees may be directed by the Property to its designated charitable partner. Immobilization procedures, fees, and removal processes are governed by applicable state and local law, which is the Property's responsibility to comply with. Beacon is not a party to any immobilization action and is not liable for any claim arising from immobilization, including claims arising from Property staff error.

11.5 Enforcement Errors


Enforcement decisions are made by Property staff based on information available in the Platform at the time of the enforcement action. Beacon is not liable for enforcement actions taken based on inaccurate information submitted by a guest, information configured by the Property, or errors made by Property staff in the enforcement process. Claims arising from enforcement actions should be directed to the Property's Guest Services.

12. Acceptable Use


You agree to use the Platform only for its intended purpose of completing parking transactions and participating in associated guest engagement features. You agree that you will not:

  • Provide false, inaccurate, or misleading information, including but not limited to vehicle license plate numbers, phone numbers, or identity information

  • Attempt to manipulate your visit count, leaderboard standing, or reward progression through any means other than legitimate qualifying scans

  • Create multiple accounts associated with the same person or vehicle for any purpose

  • Share your account or phone number with another person for purposes of accumulating rewards or leaderboard points on behalf of multiple individuals

  • Use automated tools, scripts, bots, or any other mechanism to interact with the Platform in a manner not intended for individual human use

  • Attempt to reverse engineer, decompile, scrape, or otherwise extract any portion of the Platform

  • Use the Platform for any unlawful purpose or in violation of any applicable law or regulation

Violation of these acceptable use provisions may result in immediate suspension or permanent termination of your account without prior notice or refund of any amounts paid.

13. Intellectual Property


The Platform and all content, features, technology, software, branding, QR code systems, rewards engine, and related materials are owned by Beacon Parking Group, Inc. and are protected by applicable intellectual property laws. Beacon grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for your personal, non-commercial parking and guest engagement purposes.


You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any portion of the Platform without Beacon's prior written consent. All rights not expressly granted are reserved.

14. Limitation of Liability and Disclaimers


14.1 Platform Provided As-Is


THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BEACON EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

14.2 No Liability for Lot Conditions


BEACON MAKES NO REPRESENTATIONS AND ASSUMES NO LIABILITY WHATSOEVER WITH RESPECT TO THE PHYSICAL CONDITION, SECURITY, LIGHTING, ACCESSIBILITY, OR SAFETY OF ANY PARKING LOT OR FACILITY. THE PARKING LOT IS THE PROPERTY'S ASSET AND IS THE PROPERTY'S SOLE RESPONSIBILITY. BEACON IS NOT LIABLE FOR VEHICLE DAMAGE, THEFT, VANDALISM, PERSONAL INJURY, OR LOSS OF PROPERTY OCCURRING IN OR AROUND ANY PARKING LOT.

14.3 No Liability for Enforcement Actions


BEACON IS NOT LIABLE FOR ANY CLAIM ARISING FROM ENFORCEMENT ACTIONS TAKEN BY PROPERTY STAFF, INCLUDING CLAIMS ARISING FROM BARNACLE IMMOBILIZATION, WARNINGS ISSUED, OR ENFORCEMENT ERRORS CAUSED BY INACCURATE PLATE SCANNING OR STAFF JUDGMENT. ALL SUCH CLAIMS SHOULD BE DIRECTED TO THE PROPERTY.

14.4 No Liability for Rewards or Prizes


BEACON IS NOT LIABLE FOR THE UNAVAILABILITY, DISCONTINUATION, OR FAILURE TO FULFILL ANY REWARD OR LEADERBOARD PRIZE. ALL REWARD AND PRIZE FULFILLMENT IS THE SOLE RESPONSIBILITY OF THE PROPERTY.

14.5 No Liability for Service Interruptions


BEACON IS NOT LIABLE FOR ANY LOSS OR DAMAGE ARISING FROM PLATFORM DOWNTIME, TECHNICAL FAILURES, SCAN ERRORS, OR INTERRUPTIONS IN THIRD-PARTY SERVICES INCLUDING STRIPE AND TWILIO. IF YOU ARE UNABLE TO COMPLETE A SCAN DUE TO A TECHNICAL ISSUE, YOU MAY COMPLETE PAYMENT AT THE PROPERTY'S TICKET WINDOW.

14.6 Liability Cap


TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BEACON'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE PARKING TRANSACTION GIVING RISE TO THE CLAIM.

14.7 Jurisdictional Variations


Some jurisdictions do not permit exclusion or limitation of certain warranties or liabilities. To the extent any limitation in this Section is unenforceable under applicable law in the jurisdiction where you are located, that specific limitation shall be severed and the remaining provisions of this Section and these Terms shall remain in full force and effect.

15. Dispute Resolution — Binding Arbitration and Class Action Waiver


PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

15.1 Informal Resolution


Before initiating any formal dispute proceeding, you agree to contact Beacon at info@gobeacon.us and provide a written description of your dispute. The parties will attempt to resolve the dispute informally for a period of 30 days. If the dispute is not resolved within that period, either party may proceed to arbitration as set forth below.

15.2 Binding Arbitration


Any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Platform, or any parking transaction facilitated through the Platform — including any question of arbitrability — that is not resolved informally shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under the AAA Consumer Arbitration Rules in effect at the time the dispute is submitted. The AAA Consumer Arbitration Rules are available at adr.org.


The arbitration shall be conducted on an individual basis. The arbitrator shall have authority to award any remedy available in an individual action at law or in equity, but may not award relief on behalf of anyone other than the named parties. The arbitrator's decision shall be final and binding and may be confirmed in any court of competent jurisdiction.

15.3 Class Action Waiver


YOU AND BEACON EACH AGREE THAT ANY DISPUTE SHALL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT PRESIDE OVER ANY CLASS OR REPRESENTATIVE PROCEEDING. IF THIS CLASS ACTION WAIVER IS FOUND UNENFORCEABLE AS TO ANY CLAIM, THAT CLAIM SHALL PROCEED IN A COURT OF COMPETENT JURISDICTION AND ALL OTHER CLAIMS SHALL REMAIN IN ARBITRATION.

15.4 Small Claims Court


Notwithstanding the foregoing, either party may bring an individual action in a small claims court of competent jurisdiction, provided the claim qualifies for and remains in small claims court.

15.5 Governing Law


These Terms and any dispute arising hereunder shall be governed by the laws of the State of Delaware, without regard to its conflict of law provisions, except to the extent that mandatory consumer protection laws of the state in which you are located provide otherwise.

15.6 Arbitration Costs


Payment of AAA filing fees shall be governed by the AAA Consumer Arbitration Rules. Beacon will not seek attorneys' fees or costs in arbitration unless the arbitrator finds your claim frivolous.

16. Indemnification


You agree to indemnify, defend, and hold harmless Beacon Parking Group, Inc. and its officers, directors, employees, and agents from and against any third-party claims, damages, losses, and expenses — including reasonable attorneys' fees — arising out of or related to:

  • Information you provided through the Platform that was materially inaccurate, including but not limited to vehicle license plate numbers, phone numbers, or identity information, and any enforcement action or third-party harm that resulted therefrom

  • Unauthorized use of your account or phone number by any person

  • Your violation of these Terms

  • Your fraudulent activity in connection with the Platform

This indemnification obligation does not apply to claims arising from Beacon's own negligence, Beacon's platform errors or technical failures, or enforcement decisions and actions taken by Property staff.

17. Force Majeure


Beacon shall not be liable for any failure or delay in performance of its obligations under these Terms arising from causes beyond its reasonable control, including acts of God, natural disasters, pandemic, government orders, power outages, internet service disruptions, strikes, civil unrest, or failures of third-party service providers including Stripe and Twilio. In any such event, Beacon's obligations shall be suspended for the duration of the force majeure condition.

18. Modifications to These Terms


Beacon reserves the right to modify these Terms at any time. When material changes are made, Beacon will update the version identifier and effective date of these Terms. On your next use of the Platform following a Terms update, you will be required to review and accept the updated Terms before proceeding. Your continued use of the Platform after acceptance of updated Terms constitutes your agreement to the modified Terms.


Beacon maintains a complete, versioned record of all prior Terms. If you accepted a prior version of these Terms, that version governs any dispute that arose before your acceptance of the updated version.

19. General Provisions


19.1 Entire Agreement


These Terms, together with the Privacy Notice incorporated herein, constitute the entire agreement between you and Beacon with respect to your use of the Platform and supersede all prior representations, agreements, and understandings, whether written or oral, relating to the subject matter hereof. No Property employee, Property staff member, or third party has authority to modify, waive, or supplement these Terms on Beacon's behalf.

19.2 Severability


If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be severed and the remaining provisions shall continue in full force and effect. The invalidity of any provision in one jurisdiction shall not affect the enforceability of that provision in any other jurisdiction.

19.3 No Waiver


Beacon's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Beacon.

19.4 Assignment


You may not assign your rights or obligations under these Terms to any third party. Beacon may assign these Terms, in whole or in part, in connection with a merger, acquisition, or sale of assets, without notice to you.

19.5 Electronic Records


These Terms, your acceptance thereof, and all related records are maintained in electronic form. Beacon retains a timestamped, versioned record of your acceptance of these Terms as required by the E-SIGN Act. You may request a copy of your acceptance record by contacting info@gobeacon.us.

19.6 Consumer Review Rights


Nothing in these Terms limits your right to share your honest opinions and experiences regarding the Platform, the Property, or any service received. Beacon does not prohibit, restrict, penalize, or take adverse action against any guest for posting honest reviews on any platform or medium.
